Terms of Service

These Terms of Service (“Terms”) govern your use of denverporchfest.com and the Denver PorchFest mobile app (the “App”). By using the site or App, you agree to these Terms. If you do not agree, do not use them.

Denver PorchFest is a volunteer-run community music festival operated by Denver PorchFest Inc, a Colorado nonprofit. Contact: info@denverporchfest.com.

Ticketing and donation checkout may be handled by third-party partners (currently Humanitix). Their terms apply to purchases on their platforms.

The App is for people with a valid donation ticket or organizer-issued access code. Access codes are personal. You may sign in on one device at a time. Do not share, sell, or publish your code.

We may revoke or reset access if a code is abused, shared, or used in a way that harms the event or other attendees.

• Festival map, lineup, schedule, and updates
• Neighborhood donor deals where your ticket type qualifies
• Optional event camera: with your permission, the App may use device location to confirm you are near an active PorchFest event area, and may use the camera to capture and upload photos for the event

You agree not to:

• Scrape, attack, or overload the site or App
• Bypass access controls or device binding
• Upload illegal, harassing, or infringing content
• Use the App to track or harass other people
• Misrepresent affiliation with Denver PorchFest

If you upload photos through the App, you keep ownership of your images. You grant Denver PorchFest a non-exclusive, royalty-free license to use those photos for event operations, community sharing, and promotion related to PorchFest. Do not upload photos of people who have asked not to be photographed when you know that, and do not upload content you do not have rights to share.

PorchFest happens outdoors across neighborhood porches and public spaces. Schedules, lineup, map pins, street closures, and amenities can change. Weather, city requirements, and volunteer capacity affect what we can offer. Admission to the neighborhood festival is free; donation tickets support the event and unlock App features. You attend at your own risk and are responsible for your safety and for following local laws and posted guidance.

How we collect and use information is described in our Privacy Policy. By using the site or App, you also acknowledge that policy.

The website and App are provided “as is” and “as available.” We do not guarantee uninterrupted service, perfect map accuracy, or that every listed set will happen exactly as published. To the fullest extent allowed by law, Denver PorchFest Inc and its volunteers disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent allowed by law, Denver PorchFest Inc and its officers, directors, volunteers, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site, App, or attendance at the festival. Our total liability for any claim related to the site or App is limited to the greater of (a) the amount you paid us (if any) for App-related access in the 12 months before the claim, or (b) fifty US dollars ($50).

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Courts in Denver County, Colorado have exclusive venue for disputes that cannot be resolved informally.

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the website or App after an update means you accept the revised Terms.
